Welcome to Auntie Eni’s (“Auntie Eni’s,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website and online store (the “Services”), including purchases made through the Services.
By using the Services, you agree to these Terms and our Privacy policy – Auntie Eni's and Refund policy – Auntie Eni's. If you do not agree, do not use the Services.
Our store is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products to you.
1) Eligibility and Accounts
You must be the age of majority where you live to use the Services. If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activity under your account. You may not sell, transfer, or share your account.
You agree that information you provide (including name, address, and payment details) is accurate and up to date.
2) Products and Information
We do our best to display products accurately. However, product appearance (including color) may vary by device and settings. Product descriptions, pricing, and availability may change at any time, and we may limit quantities or discontinue products.
3) Orders and Payments
When you place an order, you are making an offer to buy. We may accept or decline orders at our discretion. An order is not confirmed until we send you an order confirmation and payment is processed.
Please review your order carefully before submitting. If you need help, contact us right away—however, we may not be able to cancel or change orders after they are placed.
Purchases are subject to our Refund policy – Auntie Eni's.
You agree that purchases are for personal or household use and not for resale or export unless we have agreed in writing.
4) Pricing, Taxes, and Promotions
Prices and promotions may change without notice. Prices generally do not include shipping, taxes, or customs/fees (if applicable), which will be shown at checkout when possible.
If we discover an error in pricing or availability, we may cancel the order and refund you.
5) Shipping, Delivery, and Risk of Loss
Delivery dates are estimates and not guaranteed. We are not responsible for delays caused by carriers, weather, customs, or events outside our control. Risk of loss and title pass to you when the order is transferred to the shipping carrier.
6) Returns and Refunds
All returns, replacements, and refunds are governed by our Refund policy – Auntie Eni's.
7) Intellectual Property
All content on the Services—including trademarks, logos, product names, images, text, graphics, videos, and design—is owned by Auntie Eni’s or our licensors and is protected by intellectual property laws.
You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, distribute, or exploit any content without our prior written consent.
8) Prohibited Uses
You agree not to use the Services to:
- violate any law or regulation
- infringe intellectual property or privacy rights
- harass, abuse, defame, or harm others
- transmit malware, spam, or harmful code
- attempt to gain unauthorized access to the Services or related systems
- scrape, crawl, or use automated means to access the Services without permission
We may suspend or terminate access if we believe you have violated these Terms.
9) Third-Party Services and Links
The Services may include links or integrations provided by third parties. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.
10) Feedback and Reviews
If you submit reviews, comments, or suggestions (“Feedback”), you grant us a worldwide, royalty-free, perpetual license to use that Feedback for business purposes (such as marketing or improving our Services), unless prohibited by law.
You represent that your Feedback is truthful and does not violate the rights of others.

The Services and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Services will be uninterrupted, secure, or error-free.

12) Limitation of Liability
To the fullest extent permitted by law, Auntie Eni’s (and our officers, employees, agents, service providers, and affiliates) will not be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, or loss of data, arising from your use of the Services or purchase/use of products.
If liability cannot be excluded, our total liability will be limited to the amount you paid to us for the product(s) giving rise to the claim.
13) Indemnification
You agree to indemnify and hold harmless Auntie Eni’s and our affiliates, service providers, and partners from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Services.
14) Shopify Platform Disclaimer
Our store is powered by Shopify, but all purchases are made directly from Auntie Eni’s. Shopify is not responsible for any aspect of the sales between you and Auntie Eni’s, and you release Shopify from claims arising out of purchases made through the Services.
15) Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. You agree that any dispute will be brought in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there.
16) Changes to These Terms
We may update these Terms from time to time. The “Last updated” date will reflect the most recent changes. By continuing to use the Services after changes are posted, you agree to the updated Terms.
